Uh, not to miss the point - the DHS, like the NSA and telephones, is monitoring every flight - without any basis more than suspicion of a future crime.  Hey, it's a free country and even the DHS can fly wherever it wants - even if that means following you.

 

Just think of all the LSA cross-country flights that are suspicious - flying low and stopping at "small" airports.
