First, each owner of a TCM product has been told that the engine will perform to a specific specification. If it does not perform materially in compliance with that spec, something is wrong. Second, you need to be careful how you approach TCM because there are things they can use against you later if you do not do it right. The idea of getting a lawyer involved to write a letter demanding a meeting is to protect your rights in the event of a suit, to protect you from being time barred (i.e.. statute of limitations) and to make certain you do not shoot yourselves in the foot when you do confront TCM. By the way, the first thing your lawyer is going to do is to write a letter anyway because if he does not, he may be hit with sanctions for not trying to resolve these issues without the help of the court. Too many people think that lawyers equals trials/suits. The truth is that most of the time, they resolve problems. If you do not get one on board soon, I guarantee you TCM will not take you seriously and you will, at the very least, be wasting valuable time if not jeopardizing your rights.
