There are far too many controls on General Aviation manufacturing now. These controls prevent much of the change and improvement needed. They allow (force) manufacturers to "hide" behind "certification" by the FAA and then, inevitably they are sued by those who know they can do better! Government controllers lack the incentive to apply regulations effectively or even correctly. The controls by government can never match the incentives of a free market where one's reputation and livelihood depend on the quality and reliability of their product. Why do you think those products with the least controls are generally the most advanced and reliable. The entire homebuilt industry is an example of how the free market beats government control overtime. There are now three homebuilts sold for every one certified airplane. This shows that "free markets" overcome even the significant advantages of production efficiencies and more skilled workers. Suing is fine, people should be responsible for their products. But in the current system where we have no "looser pays" and highly ignorant non-peer juries, it may be more ethical to arbitrate a settlement with the manufacturer. They may appreciate your sense of fairness and respond in kind. You can always sue later if you leave the option open.
