"At the moment, the hydraulic ram pushes the bell crank hard against the gear
box assembly. There is slight (minimal) deflection in the box as the gear is
fully retracted and we are not sure if we are comfortable with this, however
have had to do this to get 40 degrees down movement."
Exactly how uncomfortable with this are you? Your flap actuator can tear apart at any moment, allowing your flaps to go assymetrical.
Having the flap actuator assembly push into the gearbox is terribly dangerous.
It is caused by several reasons. The most probable reason is that the throw on the flap actuator hydraulic cylinder is too long.
But, don't feel you are the only one with this problem. The factory shipped a bunch of cylinders that had excessive throw. I got one also. My gearbox wall moved a quarter of an inch.
There was much discussion of this problem about two years ago or so. Look up in the digest for the fix.
